Terms of service
By placing an order with Misty Valley Beef, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
1. Beef Orders
All beef orders placed with Misty Valley Beef are subject to availability. An order is not considered confirmed until the required deposit has been received and acknowledged by Misty Valley Beef.
2. Deposit
A $150 deposit is required to secure and confirm each beef order.
The deposit is non-refundable, including where a customer subsequently changes their mind, cancels their order, fails to collect their order, or otherwise chooses not to proceed.
The deposit is to be applied toward the customer's final order balance, where applicable.
Misty Valley Beef reserves the right to decline or cancel an order where circumstances outside our reasonable control prevent us from fulfilling the order. In such circumstances, the deposit will be refunded.
3. Final Payment
The remaining balance must be paid in accordance with the payment terms provided by Misty Valley Beef at the time of ordering.
Misty Valley Beef require payment of the outstanding balance before delivery of the beef.
Orders will not be released until payment has been received in full.
4. Order Changes
Customers should carefully consider their order before confirming it.
Requests to change an order after the deposit has been paid may not be able to be accommodated and are subject to availability and approval by Misty Valley Beef.
Changes to quantities, cuts, delivery arrangements or other order details may result in changes to the final price.
5. Product Availability and Weight
Beef is an agricultural product and individual cuts; quantities and weights may vary.
Where beef is sold by weight, the final price may differ from any estimated price provided when the order was placed. Customers acknowledge that estimated weights and prices are provided as a guide only.
Misty Valley Beef will endeavor to provide customers with accurate information regarding expected quantities and pricing.
6. Collection and Delivery
Customers are responsible for being available to receive or collect their order at the agreed time.
Where delivery has been arranged, the customer must provide accurate delivery information and ensure someone is available to receive the order where required.
Additional delivery fees may apply depending on the delivery location and arrangements.
Misty Valley Beef is not responsible for delays caused by circumstances outside its reasonable control, including weather, road conditions, transport delays, or other unforeseen circumstances.
7. Storage and Handling
Once the beef has been collected or delivered, responsibility for the product passes to the customer.
Customers are responsible for ensuring the beef is promptly stored in appropriate refrigerated or frozen conditions and handled safely in accordance with applicable food-safety practices.
8. Quality and Product Concerns
Misty Valley Beef takes pride in the quality of its products.
If you have a concern regarding your order, please contact Misty Valley Beef as soon as reasonably possible after receiving or collecting the product, providing details of the concern and, where appropriate, photographs or other supporting information.
Any issue will be assessed on a case-by-case basis.
9. Cancellations
Once the deposit has been paid, the deposit is non-refundable.
If a customer cancels an order after payment of the deposit, the deposit will be retained by Misty Valley Beef.
Any additional amounts paid toward an order will be dealt with in accordance with the circumstances of the cancellation and any applicable consumer rights under Australian law.
10. Circumstances Outside Our Control
Misty Valley Beef will not be liable for delays, changes or inability to fulfil an order caused by circumstances beyond our reasonable control.
This may include livestock availability, processing delays, equipment failure, extreme weather, transport issues, supply disruptions, natural disasters, government restrictions or other unforeseen circumstances.
Where an order cannot reasonably be fulfilled, Misty Valley Beef will communicate with the customer and work to provide an appropriate resolution.
11. Pricing
All prices displayed on the Misty Valley Beef website are subject to change without notice.
Once an order has been confirmed and the required deposit has been received, the agreed pricing arrangements for that order will apply, subject to any variations communicated to and agreed with the customer.
12. Website Information
Misty Valley Beef endeavors to ensure that information on its website is accurate and up to date. However, product availability, weights, prices and other information may change from time to time.
Misty Valley Beef reserves the right to correct errors or omissions on the website.
13. Privacy
Misty Valley Beef may collect and use customer information for the purposes of processing orders, arranging payment, delivery or collection, communicating with customers and managing its business.
Customer information will be handled in accordance with applicable Australian privacy laws and Misty Valley Beef's Privacy Policy.
14. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where a customer has rights under Australian Consumer Law, those rights continue to apply.
15. Acceptance of Terms
By placing an order and paying the required deposit, the customer confirms that they have read and accepted these Terms & Conditions, including the non-refundable deposit requirement.
Misty Valley Beef reserves the right to update these Terms & Conditions from time to time. The version applicable to an order will be the version in effect when the order is confirmed.
